Reliance on Public Data Sources:

  • Our appraisals are based on information from public records, including but not limited to data from county tax assessor offices, local Multiple Listing Services (MLS), and other publicly available data sources. While we strive for accuracy, spacedesk cannot guarantee the completeness or correctness of this data, as it is subject to change and outside our control.

 

Limitation of Scope for Desktop Appraisals:

  • Our desktop appraisals are conducted remotely without a physical inspection of the property. As such, they are based solely on the data provided by the user and available public records. Users acknowledge that desktop appraisals may not capture all factors that could influence the value of a property, such as unique property conditions or recent renovations.

User-Provided Information:

  • The accuracy of our appraisal services depends on the accuracy of the information provided by the user. spacedesk is not responsible for any errors or inaccuracies in the appraisal report resulting from incomplete, incorrect, or misleading information provided by the user.

No Guarantee of Market Performance:

  • While our appraisals aim to provide an accurate estimate of property value based on current data and market trends, spacedesk does not guarantee that the property will sell for the appraised value, or that the appraised value will match the sale price determined by the market. Market conditions can fluctuate and are influenced by numerous factors beyond our control.

Limitation of Liability for Third-Party Data:

  • Spacedesk relies on third-party data sources for many aspects of our appraisal services. We are not liable for any inaccuracies, omissions, or errors in this data, nor for any consequences that may arise from relying on this data in the appraisal process.

Intended Use of the Appraisal:

  • The appraisal reports provided by Spacedesk are intended solely for the purpose specified at the time of order, such as pre-listing valuation, tax appeal, or estate planning. These reports should not be used for any other purpose without prior written consent from spacedesk.

No Warranties:

  • Spacedesk makes no warranties, express or implied, regarding the accuracy, reliability, or completeness of the appraisal reports provided. All appraisals are delivered 'as is' and 'as available' based on the data available at the time of analysis.

Appraisal Review and Disputes:

  • If you believe there is an error or omission in the appraisal report, you may request a review within 10 days of receiving the report. spacedesk will review the report and may, at its discretion, make adjustments if a material error is found. Our liability for any claims arising from the appraisal service is limited to the amount paid for the service.

Data Retention and Compliance:

  • Spacedesk retains the workfile for each appraisal report for a total of 5 years in compliance with the Uniform Standards of Professional Appraisal Practice (USPAP). These records are securely stored and accessible only to authorized personnel. After this period, records may be securely destroyed.

Force Majeure:

  • Spacedesk is not liable for any delay or failure to perform its obligations under these terms if such delay or failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, pandemics, or technical failures.

Governing Law and Dispute Resolution:

  • These Terms and Conditions are governed by the laws of the State of Texas. Any disputes arising out of or related to these terms shall be resolved through binding arbitration in Austin, TX, in accordance with the rules of the American Arbitration Association.
